RE: Variance Request #120 - Installation of temporary fill and dewater lines to be used during hydrostatic testing operations for portions of Segment 4.

Dear Mr. Shauers:

The CPUC has reviewed the above-referenced request and approves your request, based on the following factors:

- All applicable mitigation measures for the project shall be implemented at the subject location.

- Prior to the installation of the temporary fill and dewater lines, a copy of the City of Lynwood permit for the proposed action and NPDES permit for the proposed discharge location shall be provided to the CPUC Environmental Monitor. All conditions of the subject permits shall be implemented.

- As proposed, no soil or vegetation disturbance would occur other than installation of the temporary fill lines within Fernwood Avenue (one to two potential crossings) and an unopened paved roadway (one crossing). If any signs of cultural resources are identified, work shall cease immediately, and the site shall be evaluated using the procedures in the Cultural Resources Management Plan.

- Installation of the temporary fill lines with Fernwood Avenue shall occur during nonpeak traffic hours (e.g., after 9:00 a.m. and before 3:00 p.m.). During fill line installation, half the roadway shall be closed during construction. This portion, when completed, shall be plated and the second portion of the roadway shall be trenched and plated, unless otherwise specified by the City of Lynwood. Local traffic shall continue to pass in both directions with minor delays.

- Implementation of this variance approval in accordance with the provisions noted above shall be verified on a random basis by a CPUC/ANF Environmental Monitor.
