RE: Variance Request #120 - Installation of temporary fill and dewater lines to be used during hydrostatic testing operations for portions of Segment 4.

Dear Mr. Shauers:

The CPUC has reviewed the above-referenced request and approves your request, based on the following factors:

• The proposed lines would be placed along Fernwood Avenue near East Alameda Street, City of Lynwood.

• The water fill lines would be 4-inch welded steel. Two to three water fill lines would be used based on hydrant flow availability. They would be laid above ground in the dirt parkway areas along the south side of Fernwood Avenue and east of East Alameda Street, and below ground when crossing paved roadways (one to two crossings of Fernwood Avenue required depending on hydrant flow availability and one crossing of an unopened paved roadway required).

• The dewater line would be 8-inch welded steel. This line would be placed above ground in the dirt parkway on the south side of Fernwood Avenue.

• Once the testing operations are completed, the temporary lines would be removed. Any trenches used for the temporary lines would be backfilled and all paving repairs would be completed to the satisfaction of the City of Lynwood (City permit for temporary lines currently pending).

• PPSI has received an NPDES permit for the proposed discharge location.

• Land uses along the north side of Lynwood Avenue (location of two potential hydrants for fill lines) are light industrial. Lands along the south side of Lynwood Avenue and to the east of East Alameda Street (proposed location for the above ground fill and dewater lines) are undeveloped, with the exception of limited railway improvements. No land use impacts are anticipated.

• Vegetation within the dirt parkways is limited to sage, mustard, tobacco plant, and non-native grasses and weeds. As proposed, no soil or vegetation disturbance would occur other than installation of the temporary fill lines within Fernwood Avenue (one to two potential crossings) and an unopened paved roadway (one crossing). No biological or cultural resource impacts are anticipated with the implementation of the measure noted below.

• The following measures shall be implemented:

- All applicable mitigation measures for the project shall be implemented at the subject location.

- Prior to the installation of the temporary fill and dewater lines, a copy of the City of Lynwood permit for the proposed action and NPDES permit for the proposed discharge location shall be provided to the CPUC Environmental Monitor. All conditions of the subject permits shall be implemented.

- As proposed, no soil or vegetation disturbance would occur other than installation of the temporary fill lines within Fernwood Avenue (one to two potential crossings) and an unopened paved roadway (one crossing). If any signs of cultural resources are identified, work shall cease immediately, and the site shall be evaluated using the procedures in the Cultural Resources Management Plan.

- Installation of the temporary fill lines with Fernwood Avenue shall occur during nonpeak traffic hours (e.g., after 9:00 a.m. and before 3:00 p.m.). During fill line installation, half the roadway shall be closed during construction. This portion, when completed, shall be plated and the second portion of the roadway shall be trenched and plated, unless otherwise specified by the City of Lynwood. Local traffic shall continue to pass in both directions with minor delays.

- Implementation of this variance approval in accordance with the provisions noted above shall be verified on a random basis by a CPUC/ANF Environmental Monitor.
