The following constitutes the January 1999 Progress Report for the SFPP Carson to Norwalk Pipeline Project Mitigation Monitoring, Compliance, and Reporting Program (MMCRP) contract. It should be noted that daily and weekly reports have also been issued which summarize our monitoring activities.

PROJECT MEETINGS

The following meetings were held during January 1999:

Weekly Status Meetings - Attendees: Ed Ferrer, Gerry Reed, Chuck Hughes (Kinder Morgan); Dave Cornman, Charles Smith, Jeff Reardon, Jane Vernalia (Woodward Clyde); Chuck Wadell, Jim Lamont, Mike Elmore, Fernando Orozco (Paragon Partners); Steve Hay, Steve Balkcom, Roy Helm, Steve Highland, Sam Hunt (ARB) and Kris Thorne, Christopher Meyer (Aspen/CPUC).

- January 6: Verified that Business Plan has been approved; discussed paving/capping requirements in the City of Long Beach, the necessity to apply for necessary permits for up-coming bores, status of NPDES permits for storm water discharge, and need to coordinate with transit authorities. Contractor agreed to place "No Parking" signs on both sides of the street and to remove the sawcutting mud from the gutters. Contractor agreed to have all subcontractors sign form stating that all project mitigation measures will be abided by. Applicant to prepare form for Contractor.

- January 13: Discussed possibility that underground plume of gas may require spanning Compton Creek rather than bore; Applicant will submit a variance request to open-cut (versus bore) railroad crossings. Reviewed conditions of Storm Water Pollution Prevention Plan and the need for NPDES permits.

- January 20: Confirmed that notices to local jurisdictions have been prepared and are being distributed. Applicant still working on getting NPDES permits and necessary permits for bores. An Environmental Training for Spread 2 personnel was scheduled for Tuesday, January 26.

- January 27: NPDES permits may be available next week. Discussed hanging pipe at Compton Creek crossing, Applicant was reminded that a variance would be required and to allow adequate time for review (at least 2 weeks). Caltrans permits are in place and available for review. The Environmental Training for Spread 2 personnel was rescheduled for Tuesday, February 2 (rain canceled the January 26 training).

PRE-CONSTRUCTION COMPLIANCE DOCUMENTATION

Construction of the 14-mile SFPP Carson to Norwalk Pipeline Project will traverse the following jurisdictions (from west to east): City of Carson, County of Los Angeles, City of Long Beach, City of Paramount, City of Bellflower, City of Cerritos, City of Artesia, and City of Norwalk. As required by the terms of the mitigation measure and the permitting requirements of various other regulating agencies, SFPP is required to prepare numerous plans and obtain approval of these documents prior to construction. During January 1999, SFPP completed this pre-construction compliance review for the City of Carson, County of Los Angeles, City of Paramount (Garfield Avenue only), and City of Bellflower. Construction will not be allowed to commence in the remaining jurisdictions until pre-construction compliance documentation is reviewed and approved by the applicable agencies. Map 1 (at the end of this memo) shows areas where construction has been approved.

Separate approval must also be granted prior to the start of construction for the station modification work at the SFPP facilities in Carson, Norwalk, Industry, and Colton. Construction at the Watson Station in Carson was approved in January 1999.

CONSTRUCTION MONITORING

Construction of the SFPP Carson to Norwalk Pipeline is being conducted by two separate construction spreads. Primary activities during January 1999 are presented in Table 1. Table 2 presents the non-compliance events that occurred during this time period.

City of Carson. Work within the City of Carson began with clean-up and grading of fill at the KMEP Watson Station. Pothole activities began on January 13 and trenching began in the Station on January 14. Unmarked utilities were encountered during trenching, but none were damaged. By the end of January, work within the Station was nearly complete.

County of Los Angeles. Potholing began in the County of Los Angeles on January 15. The Los Angeles County Public Works Inspector authorized construction to occur on County streets from 7:00 a.m. until 5:30 p.m., provided that no complaints were received from businesses or residents. In addition, the Inspector authorized crews to park equipment within the approved work zone if Best Management Practices for spill control were instituted and requested that only sand bags be used to protect storm drains during rain events. During the last week of January, an unidentified loaded pipeline was exposed in the trench wall during trenching of Del Amo Boulevard. All necessary steps were taken to protect the unidentified line. Rain water was pumped from the trench using Best Management Practices.

City of Long Beach. Construction within the City of Long Beach commenced on November 16, 1998. During January, construction was completed in the vicinity of Bret Harte Elementary School, a noise sensitive receptor. Trenching and special crossing crews encountered unmarked utility lines that slowed progress. A leaking storm water line delayed construction at the intersection of Artesia Boulevard and Cherry Avenue while plans were developed regarding disposal of the water. The City of Long Beach inspector extended general construction hours from 3:30 p.m. to 5:00 p.m. for January 12 only at Cherry Avenue and South Street. In addition, the City of Long Beach inspector extended construction hours for January 21 from 7:00 p.m. to as late as necessary to complete pipe installation at the intersection of Artesia Boulevard and Cherry Avenue because of traffic impacts. Unstable and contaminated soils were encountered on the north side of Artesia Boulevard. Additional shoring was installed to support the trench and a blower was used to maintain safe breathing conditions. Because of unstable soils that were threatening to collapse and impact the roadway, crews worked on Saturday, January 30 to backfill the trench at the Cherry Avenue/Highway 91 on-ramp.

City of Paramount. Potholing began in the City of Paramount on January 27. Contaminated soil was encountered at the intersection of Garfield Avenue and Jackson Street. All appropriate safety measures were implemented. Written permission was received from Wesley Gaines Elementary School to allow construction activities to occur within 300 feet of the school between 7:00 a.m. and 7:00 p.m.

City of Bellflower. Hand excavating for foreign utilities on Alondra Boulevard began in the City of Bellflower on January 28. The City of Bellflower authorized construction hours of 7:00 a.m. to 4:00 p.m., Monday through Friday.

SFPP has been informed that delays and the addition of multiple crews/spreads per segment could cause additional costs due to monitor costs. We try to reassign monitors to multiple spreads, if at all possible. In some cases, the addition of multiple spreads requires the need for additional monitors.

PUBLIC ACCESS PROGRAM

• During January, the Newsletter describing the MMCRP for the SFPP Carson to Norwalk Project was distributed by SFPP to all businesses and residences along the ROW.

• During January, the web site for the project MMCRP was completed and brought online. This web site provides updates on pipeline construction, daily/weekly/monthly reports, and variance approvals/denials. It also includes a brief description of the project, a project schedule, and links to the EIR web site where the Final EIR can be viewed or downloaded. The web site may be viewed at http://www.AspenEG.com/SFPP-MMCRP/.

CONSTRUCTION REPORTING STATUS

For January construction activities, Aspen received daily monitor field reports via modem from our Environmental Monitor(s). These daily reports are sent to the agencies via facsimile each day and posted on the MMCRP web site. In addition, weekly reports are being distributed to the CPUC and all interested permitting agencies.

PLANNED ACTIVITIES AND UPCOMING DELIVERABLES

During the month of February 1999, SFPP is scheduled to complete construction in the City of Long Beach and City of Paramount (Garfield Avenue only), with all of the Spread 1 construction crews then moving to the City of Bellflower. The Spread 2 construction crews are anticipated to complete work in within the City of Carson and continue construction throughout the month in Los Angeles County.
