Organized Markets NOPR


On June 22, 2007, the Federal Energy Regulatory Commission (FERC) issued an Advance Notice of Proposed Rulemaking (ANOPR) on “Wholesale Competition in Regions with Organized Electric Markets,” including Docket No. RM07-19-000 and AD07-7-000. 

The ANOPR addressed four specific areas and suggested possible reforms in advancing the operation of organized wholesale electric markets.  This ANOPR was of particular interest to the CPUC, because the CAISO manages one of the major organized markets that would be subject to the rules that the FERC was considering. 

The four issues addressed in the ANOPR were:

  1. the role of demand response;
  2. increasing opportunities for long-term power contracting;
  3. strengthening market monitoring; and
  4. the responsiveness of RTOs and ISOs. 

The ANOPR offered certain concerns within each area and FERC’s proposed remedies.  The ANOPR requested comments from interested parties on the areas addressed. 

The CPUC's Position

The CPUC filed comments on the ANOPR, which emphasized the work that the CPUC has already performed on each of the issues and how best the FERC can help California within these issue areas. 

After receiving and considering comments from the CPUC and other parties, on February 22, 2008, the FERC issued a Notice of Proposed Rulemaking, in which it proposed to adopt certain rules to address each of the issues on which it had sought comments in the ANOPR. 

The CPUC filed comments on this FERC NOPR in April of 2008.
