RPS Compliance and Reporting Background:

The California Public Utilities Commission (CPUC) implements and administers RPS compliance rules for California’s retail sellers of electricity, which include investor-owned utilities (IOU), electric service providers (ESP) and community choice aggregators (CCA). The California Energy Commission (CEC) is responsible for the certification of electrical generation facilities as eligible renewable energy resources, and adopting regulations for the enforcement of RPS procurement requirements of Publicly Owned Utilities (POUs). This webpage provides access to the CPUC’s RPS compliance reporting documents and describes the compliance process and rules implemented by the CPUC according to 33% RPS program established by Senate Bill 2 (1X), (Simitian, 2011). _

33% RPS Compliance Reporting

In Decision (D.) 12-06-038, the Commission implemented new compliance rules for the 33% RPS program and established a process for retail sellers to transition from the 20% RPS program to the 33% RPS program, as the 33% RPS law made several significant compliance-related changes. 

To facilitate this transition, each retail seller submitted a “Provisional 20% RPS Closing Report” to report its percentage of RPS procurement made in 2010 and the net surplus or deficit procurement amount for all RPS compliance years prior to 2011.  Retail sellers will submit final 20% RPS Closing Reports after the California Energy Commission verifies RPS procurement claims for compliance years 2008-2010. 

Retail sellers are required to submit Annual RPS Compliance Reports on August 1 each year to demonstrate progress towards the RPS procurement requirements.  After the California Energy Commission verifies RPS procurement claims for each compliance period, retail sellers will submit Verified Compliance Reports from which the CPUC will base its compliance determination on.


Energy Division staff, in collaboration with RPS stakeholders, developed an Annual 33% RPS Compliance Report spreadsheet for retail sellers to report 2012 RPS compliance positions incorporating RPS compliance rules implemented by D.12-06-038.  Pursuant to D.12-06-038, all retail sellers subject to the jurisdiction of the CPUC filed a 2012 Annual 33% RPS Compliance Report on or before August 1, 2013.

The Commission will formally adopt the RPS compliance reporting format in the RPS proceeding (R.11-05-005) after the RPS enforcement rules are established.
