R.04-04-003 Straw Proposal

As part of the Nov. 29, 2005 workshop notice, Energy Division stated its intent to circulate a straw proposal prior to the Dec. 9, 2005 RAR 90% Compliance Showings (D.05-10-042/R.04-04-003) workshop.

The enclosed straw proposal contains five elements that will assist Load-Serving Entities (LSEs) with the January 27, 2006 90% compliance showings to be filed via advice letter by all LSEs:

1. Guide for Load-Serving Entities (LSEs) on the "2006 Resource Adequacy Resource Reporting Template."

2. Compliance Reporting Template: Enclosed as an MS-Word file is the "2006 Resource Adequacy Resource Reporting Template" which was developed by the CAISO in consultation with the CPUC Energy Division.   Note: This template is a refinement of the template that appeared in the Phase 2 Workshop Report as Appendix I, p.4-5, Exhibit 1, CPUC Resource Adequacy Template Draft Version 1.0.

3. Proposed Implementation of the Mirant Top Down Methodology as adopted in D.05-10-042 (Description in MS-Word).

5. Liquidated Damages (LD) Contract Baseline Table. D.05-10-042 adopted "a variation of the declining share of RAR portfolio approach to balance the LSEs' need for time to adjust their portfolios away from LD contracts, and the need to make progress toward our goal of a physical capacity-based RAR program. Each LSE will be allowed to include LD contracts in partial fulfillment of its RA obligation, subject to the declining limits set forth in the following table:" (D.05-10-042, Section 7.4, p.65)

Below is a file on LD contracts, which should form the basis for an MS-Excel spreadsheet. LSEs should list all LD contracts executed prior to October 27, 2005. The LD Contract Baseline Table will form the baseline against which future declining limits figures will be calculated.

How To File An Advice Letter.  The Commission's advice letter filing procedures are set forth in General Order 96-A, III. Rules For Submission Of Tariff Sheets (beginning on p.7 of the PDF file). (The advice letter filing process was originally developed as part of the tariff sheet review process). GO 96-A requires that LSEs file four copies of each advice letter, one of which will be returned to the LSE upon approval of the filing. Newer LSEs may opt to read the filing details set forth in GO 96-A, or simply follow the general advice letter form shown by PG&E, SCE, or SDG&E advice letter filings:
