UPDATED PRACTITIONER ALERT

COVID-19 Temporary Filing and Service Protocol for Formal Proceedings


Attention All Practitioners:

In view of the COVID-19, the extended shelter in place orders and the need to plan for smooth and phased transition out of the sheltered-in operational mode, the below temporary COVID-19 Temporary Filing and Service Protocol will remain in effect for all formal proceedings, until further notice:


  1. Filing of Confidential Documents

    Service and mailing requirements and the hard copy filing of confidentiality motions and confidential documents with the Docket Office are suspended until further notice.

    Practitioners still must continue to serve electronically the public versions of the documents.

    Confidentiality motions relating to documents and motions served and/or filed between now and until this protocol is lifted shall be filed with the Docket Office within 30 days of this protocol being lifted or as directed by the assigned Judge.


  2. Paper Copies of E-Filed Documents

    Commission Rule of Practice and Procedure, Rule 1.10 (e) requirement to serve paper copies of all e-filed documents to the Administrative Law Judges is suspended until further notice.

    Rule 1.10 (e) requirement will resume as soon as this protocol is lifted.


  3. Proponent's Environmental Assessment (PEA) Filing Requirement

    Commission Rule of Practice and Procedure, Rule 2.4 requirement to tender the PEA copies by filing the same in a CD-ROM/DVD format is suspended until further notice.

    Rule 2.4 requirement will resume as soon as this protocol is lifted.

    All CD-ROM/DVDs that should have been tendered for filing, but for the current COVID-19 Temporary Filing and Service Protocol for Formal Proceedings, shall be filed with the Docket Office within 30 days of this protocol being lifted or as directed by the assigned Judge.


  4. Electronic Service

    All requirements for delivery or service personally or by mail for filings are suspended until further notice.

    Until further notice, service is limited to electronic service. 

    All requirements for delivery or service personally or by mail for filings resume as soon as this protocol is lifted.
