On December 22, 2014, the California Public Utilities Commission (CPUC) issued Resolution ST-163, which approved a citation program under the administration of the CPUC’s Director of the Safety and Enforcement Division (SED) (on July 1, 2019 the former Office of Rail Safety, which was part of SED, was separated from SED and is now called Rail Safety Division or RSD) for enforcing compliance with certain CPUC General Orders and other requirements for rail transit agencies operating in California. Specifically, the citation program will aid in ensuring compliance with the requirements for walkways, clearances, roadway worker protections and certain rail fixed guideway system operating rules. Staff is delegated authority to draft and issue citations for specific violations and levy penalties in specified amounts as set forth in the Resolution.

On July 2, 2014, CPUC issued Resolution ALJ-299, which established a pilot program that requires all citation appeals to be filed with the Commission’s Docket Office so that all interested parties, Commission Staff, reviewing courts and the public at large will have a central location from which to access the record of citation appeals. The pilot program also enacted several procedural appellate rules and harmonizes others to further due process and administrative efficiency in processing citation appeals. The appellate rules under this pilot program became effective on January 1, 2015.

The Rail Transit Citation Program established by Resolution ST-163 is subject to the appeal process established under Resolution ALJ-299.
