Decision (D.)21-06-026 authorized the CPUC to publish a list of solar providers whose interconnection applications have not complied with certain state laws or regulatory agency rules and regulations. A detailed list of these statutes and regulations is found in Section 4 of D.21-06-026. For purposes of this list, a “solar provider” is a person or entity who contracts with a customer of an investor-owned utility to install, finance, or otherwise procure a solar system through California’s program(s) for renewable energy customer-generators, currently net energy metering (NEM).

The CPUC updates this list quarterly. Solar providers added to the list will be notified by the utility to which they submitted the non-compliant interconnection application(s). The notices include details of the solar provider’s consumer protection violations, non-compliant interconnection applications, and instructions for requesting removal from the list (see below).

Interconnection applications from solar providers on the Watch List are subject to enhanced reviews and audits by utility and agency staff.

Removal from the Public List

Solar providers that submitted applications found to be non-compliant will remain on this list for two full quarters. For example, a solar provider placed on the list for the fourth quarter of 2022 will remain on the list until the end of the first quarter of 2023. Solar providers who submit applications found by agency staff to be non-compliant with applicable consumer protection laws, rules, or regulations in subsequent quarters will remain on the Watch List until the end of the second full quarter after they commit their most recent violation.

If a solar provider believes it is on the Watch List in error, the solar provider may send to the utility and/or the CPUC documentation sufficient to show that the solar provider did comply with the relevant consumer protection laws, regulations, or rules. More information about submitting a removal request can be found in Section 4.1 of D.21-06-026 and in the utility notice sent to each listed solar provider.
