Protesting an Advice Letter

If a customer or other interested person disagrees with what is being requested in an Advice Letter, a written protest can be submitted to the Water Division at Water.Division@cpuc.ca.gov within 20 calendar days after the Advice Letter is submitted to Water Division for review.  The protest must also be submitted to the utility at the same time at the address provided in the Advice Letter.  The protest is a document that must raise a substantive issue and may not raise issues that go beyond the scope of the Advice Letter request and may not propose alternatives that contradict a Commission decision underlying the Advice Letter request.   The grounds for a protest are found at General Order 96-B, Rule 7.4.2. The utility is required to provide a response to the protest within 5 business days after the end of the protest period.  After reviewing the protest and utility's response, Water Division will issue a Disposition Letter for Tier 1 and 2 Advice Letters to resolve both the Advice Letter and any protest(s).  For Tier 3 Advice Letters, protests are addressed and resolved by the Commission in its Resolution disposing of the Advice Letter.
