The Right of First Refusal (ROFR) must be received by January 15 of each year, detailing areas where an existing facilities-based broadband provider intends to upgrade service within 180 days. An ROFR may be renewed only with the agreement of the Commission, and only in the event of delays outside the provider’s control. Per Resolution T-17590 an existing provider will have until January 15, 2018 to make a commitment to the CPUC to upgrade their broadband networks in existing underserved territories using their own funds.  

Per Resolution T-17443 an existing provider will have until November 1 2014 to make a commitment to the CPUC to upgrade their broadband networks in existing underserved territories using their own funds.
