Video Franchise Workshops

The Digital Infrastructure and Video Competition Act of 2006 (DIVCA) streamlined the video franchising process by placing the state’s franchising authority under just one government agency, the California Public Utilities Commission (CPUC). The CPUC is the sole entity responsible for determining which companies are qualified to operate as state video franchise holders in California.

On April 17, 2023, the CPUC opened Rulemaking (R.) 23-04-006 to consider changes to General Order 169: Implementing DIVCA. The CPUC must also adopt consumer protection rules, adjudicate customer complaints, and more detailed reporting requirements regarding video services. The CPUC can also consider potential ways to modernize and make the implementation of DIVCA more efficient and effective.

Rule 7.5 (a)(2) of the CPUC’s Rules of Practice and Procedure requires the CPUC host “[a]t least one workshop providing an opportunity for the parties to the proceeding to have an interactive discussion on issues identified in the scoping memo. The CPUC holds workshops such as a workshop to facilitate collaborative discussions among advocate and industry parties, local governments, consumers, and other stakeholders.

The purpose of the workshop is to provide stakeholders with an opportunity to engage in an interactive discussion on issues identified in the Assigned Commissioner’s April 3, 2024, Scoping Memo and Ruling (Scoping Memo), for R.23-04-006 including consumer protection rules, adjudication of complaints, reporting requirements, environmental and social justice efforts, enforcement and penalties, and the application and renewal processes.
